Our case managers will help you step-by-step through the process of filing required paperwork for your workers compensation claims, advise you on important deadlines, and ensure that Dr. Martens has the most up-to-date information regarding your claim. Dr. Martens has over 14 years of experience in workers compensation in his 18 year career as a physician. Our entire staff understands that having an injury or occupational disease can impact your life and you will be treated with respect and compassion. We offer Return-To-Work Programs and have an on-site Physical Rehabilitation center with experienced rehab staff. We are here to help and we will get your claim open so that you receive the medical treatment you deserve.

FREQUENTLY ASKED QUESTIONS
Q: I was injured on my job, what do I do?
A: Report your injury to your supervisor immediately.
Q: Can I see any doctor of my choice?
A: Yes. As long as they accept OWCP.
Q: Which forms do I need to file a claim?
A: The CA-1 and CA-2 forms allow injured workers to file a notice of claim. The CA-7 form allows injured workers to claim wage compensation benefits.
Q: My employer will not report my injury. What can I do?
A: Escalate the issue to higher management.
Q: Can I choose my treating doctor?
A: Yes. As long as they accept OWCP.
Q: Is there a timeline for filing a claim?
A: In most cases, the CA-1 must be submitted by the agency to the Office of Workers’ Compensation Programs (OWCP) within 10 days of notification by the employee. The Federal Employees’ Compensation Act provides that a claim for compensation must be filed within 3 years of the date of injury. For a traumatic injury, the statutory time limitation begins to run from the date of the injury. For an occupation disease or illness, it begins to run when an injured employee with a compensable disability becomes aware, or reasonably should have been aware, of a possible relationship between the medical condition and the employment.
Q: Are workers’ compensation benefits taxable?
Q: While unable to work and collecting temporary workers’ compensation disability benefits, my employer discontinued my health care coverage. Is this discontinuation of coverage permissible under the law?
A: Yes. But DOL will handle the deductions when notified.
Q: How do I request a change of physician?
A: To request a change of physician, put the request in writing, detail the reason why you wish to change physicians, include the new physician’s name, specialty, and contact information, and sign the request. This may be mailed to the U.S. Department of Labor, DFEC Central Mailroom, P.O. Box 8300, London, KY, 40742-8300.
